The federal COBRA law applies to companies with 20 or more employees. If you are let go, your hours reduced or have another qualifying event that triggers a COBRA open enrollment period, your employer must offer you a continuation of the same health benefits that you had that when you were employed.

Texas Has Mini-COBRA Insurance Law

The federal COBRA benefit is available for up to 18 months or 36 months depending on the reason. In Texas, you have additional rights for continuing former employer’s group health plan. If you work for a company that provides insurance benefits with less than 20 employees, the Texas State Continuation law allows for nine months of coverage of the same health plan. Additionally, if you have used all 18 months of federal COBRA, Texas law extends coverage for an additional six months thereafter.
