Code Number:993300 Q: Code Number:993300 I am under COBRA due to a divorce. When I remarry does cobra end, or can I continue it for the duration of the time remaining? Code Number:993300 A: Yes. Divorce or Legal separation are triggering events that allow you to continue on the same group health plan offered by the employer. If you are coming off the insurance due to divorce, you have up to 36 months of continuation coverage. If you remarry with in that time, you can still stay on your COBRA coverage as long as you do not have insurance with your new spouse that covers your preexisting medical condition. (Meaning, you are not allowed under COBRA to have double coverage unless there is a pre-existing clause and a waiting period.)
