Is An Employee On Worker’s Compensation Eligible For COBRA?
One of our employees is currently on workers comp. Meanwhile we are still paying his health insurance premium. Are we required to continue paying the premium or should we offer him COBRA?
Under the federal COBRA law, the employer may have a choice of whether to continue paying the employee’s insurance premium or to offer COBRA continuation of health insurance coverage.
The exception would be if the leave is also covered by the Family and Medical Leave Act (FMLA). In that case, you (the employer) are still responsible for the same coverage commitment as before the leave.
