Q: I was previously covered under my spouse’s group plan ending June 30. Her new plan starts July 1. However, I will not be eligible for coverage under her new plan if I have my own group coverage. I will not since I am also starting a new job and am not eligible for 90 days. However, the new employer will subsidize COBRA premiums. Can I legally get COBRA coverage on my spouse’s old plan even though I am qualified for her new plan (the premium cost is higher for family vs. my individual premium)?
